By using this website or contacting Byron White Formulas™, I have read, understood and I am agreeing to the following terms and conditions:

The word “formula” in this agreement is meant to refer to all Byron White Formulas™ and products.

 

Morals and Negligence:

We reserve the right not to sell or continue to sell to a doctor or practitioner, if we find said practitioner is under investigation for medical incompetency or misconduct or has other legal or moral violations, or is currently on probation. We reserve the right to refuse business to those that are verbally abusive, threatening, argumentative, demeaning and/or hostile. We also reserve the right to refuse service and sever communication with anyone at any time.

Placing an order on our website:

By registering to use our online shopping cart, it allows you access to the shopping cart, but it does not imply a contract to provide formulas to you. We retain the right to modify, delete your account or refuse service without prior notice.

By placing an order of any Byron White Formulas™ through this site, or by phone or e-mail, you agree that you are a licensed or certified practitioner/office manager and fully understand not to give out your password to patients, the general public or other practitioners. Your username and login capabilities are strictly for yourself and/or your medical office. Any use other than this purpose may result in an account suspension.

You understand that after placing an order, you cannot make further changes or adjustments to that order. However, order cancellations will be accepted. Once your order has been placed in our online shopping cart, we will send you a confirmation email in regards to your order. This constitutes an offer from you to buy our formulas and proposed payment. All orders are subject to acceptance by us before being processed.

Purchasing:

You understand and acknowledge that the formulas do not treat, cure or prevent any disease and that you are responsible for you, your patients and clients care and we are not legally responsible for any use or misuse of our formulas by you, your patients or clients. You agree when purchasing that you are in fact licensed to practice medicine and are monitoring your patient’s care when providing our products to them.

Availability:

Although formulas are displayed on our website, this does not reflect that these are available or in stock. If you order a formula that we do not have sufficient supply, we will notify you immediately and provide you with the opportunity to cancel, wait or modify your existing order.

All orders placed with our online shopping cart are considered final, when submitted for payment and you cannot add anything to that order once it is placed.

Shipping:

Orders placed and received by us, prior to 2pm, PST will usually be shipped within 2 business days. Orders based in the United States typically take from 1-5 business days to be received. We are not responsible for shipping delays based on the United States Postal Service or any other carrier. Although we do provide rush orders, we will need to be contacted ahead of time. We cannot guarantee that orders will arrive on a specific day or in a specific time frame. Please leave plenty of time to receive your order.

Orders shipped outside of the United States may incur additional charges that we are not aware of. We are not responsible for paying for these additional charges if they apply. Nor are we responsible for custom delays, charges or refusal or fees for returning shipments.

Prices and Payment:

All prices on formulas are subject to change without notice. It is possible that despite our best efforts, some formulas on our shopping cart pricing may have changed. We are not obligated to provide formulas at an incorrect price. Over time, prices may change. We make every effort to alert you of these changes before they occur.

Payment for all formulas must be by Credit, Debit Card or Check. Orders done by Check will be held until payment is received for 5 business days from placing an order in our online store. If payment is not received within 7 business days, we have the right to cancel your order and restock the contents of the order.

Privacy of Information:

By using the shopping cart, you agree that all formulas, prices and informational material on this website are not to be distributed, shared, either by e-mail or other electronic means, or copied by anyone. All information on this website shall be regarded as informational material only and for your own use.

You agree to hold Byron White Formulas™, Byron White and associates harmless legally for anything that may transpire with the posting of your confidential and financial information in the use of our website and shopping cart as well as in the use of our formulas.

Any information provided to us from you will not be distributed without your prior permission. Your Credit Card information will not be kept on file.

When placing an order through our online shopping cart, you acknowledge that any means of transferring your credit card or private information other than by phone or through our secure payment gateway may present a financial risk to you. You agree not to send us your credit card information by any other means. You understand that if sending us sensitive information by anything other than phone or through our online encrypted payment gateway may pose a financial risk that we cannot be held legally responsible for. All information transmitted to us over the Internet is, and is treated as non-confidential and non-proprietary (except concerning what is posted in this terms of conditions).

You may not post any information on this website that is unlawful, threatening, defamatory or that would otherwise be offensive to others or violate any laws, known or unknown, in this state or other states.

Website Images & Content:

All images, logos, trademarks and information on this website are subject to copyright laws and may not be used or distributed without our prior written permission.

Formula Reviews:

The makers, without an offer of compensation, volunteered any comments on formulas or services. The results referred to may not be typical and others’ results may vary. We have the right to remove any formula or service comment at any time.

Returns:

Byron White Formulas, Inc is unable to accept returns.

Amendments to this agreement:

We have the right to amend these terms and conditions at any time and any revised version will be effective immediately once updated on our website. You are subject to the terms and conditions at the time of signing up with an account or ordering formulas from us, or utilizing the website.
